SMS Terms & Messaging Policy | BlueVault Dallas, Orange County, and San Diego

This SMS Terms & Messaging Policy (“SMS Policy”) governs the use of text messaging services provided by BlueVault Secure Inc (“Company,” “we,” “us,” or “our”). By opting in to receive SMS or MMS messages from us, you agree to the terms described in this policy.

This SMS Policy applies to all text messaging programs operated by the Company, including marketing, promotional, and transactional communications.

Consent to Receive Text Messages.
- By providing your mobile phone number and opting in through our website, checkout page, account registration, promotional form, or other sign-up method, you provide prior express written consent to receive recurring text messages from the Company.

- To stop receiving messages:
  - Reply STOP to any SMS message you receive from us.
- After you send the STOP command, we will send a confirmation message confirming that you have been unsubscribed. After this confirmation, you will no longer receive marketing text messages from us.

  - Reply HELP to any message you receive from us, or

Supported Carriers.
- SMS messaging services are supported by most major wireless carriers. However, carriers are not liable for delayed or undelivered messages.
Privacy and Data Use.
- We respect your privacy. Any personal information collected through our SMS program will be handled in accordance with our Privacy Policy.
- Information collected may include, but not be limited to, 1) Mobile phone number, 2) Messaging activity, 3) Consent records, or 4) Device information.
- This information may be used for 1) Delivering text messages, 2) Maintaining compliance with telemarketing laws, or 3) Customer support and service improvement.
- We do not sell your phone number to third parties for their marketing purposes.
Compliance With Telemarketing Laws.
- The Company complies with applicable federal and state laws governing telemarketing and text messaging, including 1) The Telephone Consumer Protection Act (TCPA), 2) Federal Communications Commission (FCC) regulations, and 3) State telemarketing and consumer protection laws.
- We maintain records of consumer consent and messaging activity as required by law.
State Law Disclosures.

Texas Residents – Texas Senate Bill 140 (SB 140).
- Effective September 1, 2025, Texas law regulates marketing text messages under the Texas Business & Commerce Code related to telephone solicitations, as amended by Texas Senate Bill 140 (SB 140).
- In compliance with Texas law:
  - Messaging Time Restrictions
    - Marketing text messages sent to Texas residents will only be transmitted during the following hours based on Texas local time:
      - Monday through Saturday: 9:00 a.m. – 9:00 p.m.
      - Sunday: 12:00 p.m. – 9:00 p.m.
    - We implement systems and procedures intended to ensure that marketing messages are not sent outside these permitted time periods.
  - Consumer Rights
    - Texas residents may:
      - Request to stop receiving marketing messages at any time
      - Be placed on our internal do-not-text list
      - Contact us regarding any messaging concerns
    - We maintain records necessary to demonstrate compliance with Texas telemarketing regulations.
Internal Do-Not-Call / Do-Not-Text Compliance.
- The Company maintains an internal suppression list for consumers who have opted out of receiving marketing communications.
- Consumers who request not to receive marketing messages will be added to this list and will not receive future promotional SMS communications.
Changes to This SMS Policy.
- We may update or modify this SMS Policy at any time to reflect changes in our messaging practices or legal requirements.
